If not...Here's the synopsis.
I was riding as the passenger in a service truck at work. Driver makes a left hand turn, door springs open I fly out. In the process I rolled, dislocated a finger, got some road rash and a few stitches.
Fast forward to today. I take off from work at 11:30 for a doctors appointment to remove my stitches. Got back to work at 1 in the afternoon. I come in to find that a shaft fell out of one of the sort screens. No biggie. Me and the other guy can handle it. Well, we did. With the help of a low seniority guy from graveyard. None of the other guys from grave with more seniority got called.... My and my buddy think "That's strange? those guys are always willing to come in for OT."
Anyway, the work got finished. My manager tells me "Go ahead and put your tools away and change into your street clothes then meet me in my office."
Right off the bat I'm thinkin something is wrong. It's 3 hours before me shift ends. AND This a$$hole has been trying to get rid of me ever since I disagreed about him not having to do anything since he was foreman....
I get down to his office and am HAPPILY greeted by him and the site manager. They hand me a 5 day unpaid suspension starting next week for breaking one of "The 10 MRF Golden Rules" (of which I've NEVER heard of until today!). Which was??? Not wearing a seatbelt. They also conveniently wait until the work got done and all the union reps. have gone home for the day to hand me this load of crap. 10 minutes later, the driver of the truck gets the same suspension. Well.... Found out why turd nugget got called in!!! Turns out HE'S one of the namagers bestest buddies TOO.
Well...Kinda BS because the truck DIDN'T HAVE seatbelts because it was an "On-Site Only" truck. SECOND thing... NO ONE ...Not even the district manager etc. wears seatbelts while on the site. Now suddenly after a faulty door latch fails, supposedly EVERYONE wears a seatbelt and it's always been required.
Next thing is, they violated the union contract by disciplining me without my union rep. present. But when I bring these points up, they say I'm dead wrong. Also, the people who I THOUGHT were my friends there turned their backs and flat out LIED saying that they always wear seatbelts.
NOW I'm up the creek and going to have to yank a paycheck outta my rear end when it comes time to pay the mortgage in 2 weeks... All because of some turd polisher with a Napoleon Complex.
This *_*_*_*_*_*es me off to no end.......You can win for loosin with this damn company!!!

At least I work next door to the shooting range... I went home, got my 1911, grabbed 800 rounds of ammo and went back for some target practice.
I saw the looks on some of the peoples faces who were in the meeting. They saw me at the range and it looked like they were trying to pass kidney stones. Probably thinking I was going to go back onsite and re-enact the Ft. Hood incident.

Truck had no seat belts + no Union rep. = real big BS.,,They were being real SLICK!
Them chumps railroaded you!

Man that sux. There are ways of getting even without them thinking you had anything to do with it. The union will take care of though wont they??

A good friend of mine is married to a Labor Lawyer. I plan on taking this to court. I'm not the usual California "Sue Crazy" person. This is the first time I've ever thought about doing it. But I'm tired of being walked on for doing my job, while the folks that DON'T do their jobs get praised for it!

There definitly is Vinny. I've already started that process.
The Union hasn't said anything yet. The business agent assigned to my site told me "Sit Tight, we'll see what happens on Monday."
Which I also think is a load of BS. He still hasn't done anything about my prior grievances for back double time pay and a few other things.
It seems like the company is going after me because I'm the only one in my department willing to stand up for myself.

I believe that having the Doc. give you a clean bill of health was a bad thing, for you. You should have nursed this accident for everything you could ! I thought that I had read how badly they were treating you before, AO one and ALL !
If I were you, I wouldhave that sharp pain inyour back looked at, thatpain that suddenly became worse you mentioned ! Sue them for not having seat belts, and operating an unsafe vehicle ! I'm sure the Labor Laws in California are as liberal as they come.
I understand that you can claim Workmans Compensation for Mental Anxiety, as well as Muscular Back Pain !
They waited until they felt safe that you wouldn't go after them. Then they turn on you. Or, they do everything to make the accident look like it was your fault, to cover their buts.

You're absolutely right Bill. They've done it to other guys before, and I'm ashamed to say that it happened to me too.
While I DO plan on sueing them, I don't plan on collecting workmans comp. See, here in great old Commiefornia if you elect workmans comp, then you give up your right for legal recourse. Pretty much means ya can't sue because of a contractual agreement between the Insurance company, the company and the worker. Kinda screwed up huh?
I just talked to my Shop Steward a little while ago. He went in to work today and took maybe 2 hours of video and a whole roll of 35mm film of people who work for the company driving without seatbelts. He says just about every one of them was a misManager or Stupidvisor.
Hopefully things turn around on Tuesday when my lawyer contacts the people in charge there. Because what she told me last night is that she plans set the damages in an amount followed by 6 zeros when it goes to court. I was told that she would inform the company first of the proceedings then give them a chance to settle and bring me back in, or go to court....We'll see!

Man that's f'd up. What's the world coming to when co-workers (regardless of line or manager) aren't more concerned and happy you are going to be okay than to stick it to you. What a JA.
I'd take some photos or video of that super w/o a seatbelt, smoking on the job and not washing his hands after taking a pi$$.
Hope your lawyers a royal beotch and rips them a new one.
