Heads-Up and Beware!
« on: February 25, 2009, 10:28:57 AM »
I was just on the American Airgun Classifieds and happened across this sales ad...    do not respond to it- it is very likely a STING!  We ALL know the legalities of sound moderators, LDC's, s-words and such and I emailed this guy the following message:

Me:  Two words for you...   Sting Op.

He responded with:  Hehehehehe!

I may be wrong but this proves the point.  There was no mention of these moderators being legal in the US in his return email, no mention of anything of their legality at all.  Just "Hehehehe..."

There's a word for this quality of Federal conduct...  it's called "entrapment".

I seriously doubt it's a sting op.  I think our law enforces have a lot more important things to do right now than entrap airgunners into buying a thingy.  It's probably:

a) a complete idiot who isn't aware of the laws and is trying to make a buck
b) someone offshore who can unload merchandise inland without little legal repercussion for himself
c) someone who doesn't care about the law and doesn't think he'll get caught

So this cat has emailed me back a couple times now and apparently he's done the research and these LDC's are indeed legal.  How, I have no idea but he was at the Shot Show and personally asked the feds about it and they're good to go.

My question is...    WHAT IF???

What if Joe Schmoe law enforcement officer/NSA guy/ FBI doesn't know the difference and puts someone behind bars for these little gems?

Not trying to be a paranoid here just looking at it realistically.

Local sherrif says they are legal on air guns in my county. The best way to find out is to ask the local enforcement guys, they would be the ones coming for you anyway....

"Texas",,, Im scared to even click on the link you provided!! :o  Seriously though Matt,,, I have done alot of research on this matter. Now we ALL know,,, illegle "suppresion" devices are STRICTLY forbidden to be discussed here at GTA. And rightly so. This is a very sensative issue. Honestly,,, there is alot of "Gray Area" in the way the current laws are "written". My best understanding of the most current updated "Law" I read is: "Sound Suppressing" devices are "ok" on paint ball guns & airguns,,(pellet guns??????) if they are permanently attached in such a way that attemps at removal will "destroy" the gun or device,, rendering BOTH un useable. Case in point:,,, "Roe Vrs Gamo",,,,,, Whisper????? Seriously Folks,,,, Gamo is still in buisness,,, they have no problem advertising the heck out of the "Whisper"!! :o  That is a full fledged "illegle device" on the end of that gun complete with baffles & all!! I dont think BATF is sitting around building cases over "Quiet" arguns being used for Squirell hunting?? :p  If they were,,,Gamo would have let us know!! (So would AirForce) Tallon SS?????? :o  Aftermarket devices however,,,,,, now thats a whole differant ball game!! I bet an "LDC" for a Dragon Slayer would see many doughnuts hit the floor FAST!! :p  (Rightly so) Im very hesatent to post this,, but,, after re reading it,, I think Im gonna. It is certainly a "Grey Area" of the law. But,,,, the rules here at GTA are VERY explicit. I hope this post of mine only gets me a "slap on the wrist"  I just wanted to add my 2 cents.  Tim.
