I spent the whole afternoon doing video and acceleration tests.I had a trial scheduled to start tomorrow.By my experts analysis the "eye witnesses" are about 35 mph off. I believe our video testing will show how perception differs from reality. With all due respect to Jeff I have run into the 1% he talks about more times in my career than I care to count.Sometimes it's little things like a speeding charge: sometimes its not. At one point, while I was a prosecutor, Ilearned I had two cops who were breaking into suspects homes looking for evidence to base a search warrant on (ie burglary).I have had cops lie, boldly, under oath, and caught them at it: with pictures and with prior forgotten statements. I have had officers base tickets on the statements of one party to an accident never bothering to even talk with the other driver. Any time you allow subjectivity to act as evidence in the alleged commission of a crime, and a traffic ticket is a crime, you throw the concept of, "beyond a reasonable doubt" out the window.Ask yourself, how can you have evidence beyond a reasonable doubt when you don't have any specificity or objectivity in the evidence. The questionaught to suggest the answer: you can not.Once you have invaded the standard of proofrequired for a criminal conviction you have invaded the protections set in place by the Constitution. It's only a speeding ticket, you might argue, or those hooligans need to be slowed down. I answer, you can use such an argument anywhere anytime and it carries no more weight now than in any other context.The dilution of our rights is a slippery slope than once slid down is hard to claw your way back out of.

OK, as a former prosecutor, what would you have made of a ticket for running through a school zone at, to any reasonable man's estimate, well over the posted 25mph speed limit? You have a police officer's eyewitness report as well as, say, the crossing guard's. Would you not pursue it because there was no "hard evidence"? If a person is doing nearly a hundred miles per hour, does a policeman have to let him go simply because he can't clock him? What I would like to know are the particulars of this ruling. What, exactly, happened?



And, from your experience, does it follow that all police officers are corrupt, liars, etc? I've known one or two guys who should never have been policemen, myself. That doesn't mean that the rest of the barrel is rotten.

Bill, I certainly don't need a history lecture. I was asking the prior poster what I felt was a legitimate question. It's not necessary to jump in and quote the founding fathers. Incidentally, if you know YOUR history, you might find that some cherished parts of the Constitution were never originally meant to hold their current interpretations. Some of those blue bloods didn't think the common man could competently look after himself. Thankfully, they wrote better than they perceived.

Yes Red,



I know of these parts of the Constitution that have been adjusted or re-interpreted by men that deemed it in their best interest. And allowed by Supreme Court Justices that may have never read the Constitution or the Bill of Rights.



But that is no excuse to relinquish your rights, or mine !



You may feel that we haven't lost enough of our rights, but I do !

Now THAT'S the way things are supposed to work in America ....... the people disapprove of a law and their elected public officials  quickly respond to the wishes of their constituents and immediately go to work to have the law repealed  !!!!    I commend those 2 politicians for working so quickly on behalf of the people who elected them.      

It would be nice if the system always worked like this  !!

I'd like too think my e-mail's & call's helped & I know it was ALL of us OHIOIAN's that stood UP for once that did it ,now to just stay on them an make sure it's a forgotten ruleing by our dumba$$( most likely really)" HIGH" court!!!The system still work's, FOR now at least.
